The disclosure below must be shown by itself on its own screen (standalone document), with nothing else on it except the disclosure. The authorization is a separate screen. Counsel and the consumer reporting agency must approve final wording.
Disclosure Regarding Background Investigation
A&A Terra Inc ("the Company") may obtain information about you from a third-party consumer reporting agency for the purpose of deciding whether to approve you to receive delivery offers on its platform as an independent contractor, and, if approved, at any time while you remain on the platform, to the extent permitted by law. As a result, you may be the subject of a "consumer report" which may include information about your character, general reputation, personal characteristics, and/or mode of living. These reports may contain information regarding your criminal history, motor vehicle records ("driving records"), verification of your identity, and other background checks.
The consumer reporting agency is: Checkr, Inc. [counsel to confirm], [mailing address — to be added], [phone — to be added], https://checkr.com/candidate. (The app shows the same name from the CRA_NAME / CRA_CONTACT settings.)
You have the right, upon written request made within a reasonable time, to request whether a consumer report has been run about you, and to request a copy of your report. A Summary of Your Rights Under the Fair Credit Reporting Act is provided with this disclosure (the CFPB summary: https://files.consumerfinance.gov/f/documents/bcfp_consumer-rights-summary_2018-09.pdf).
Authorization (separate screen)
By typing my full legal name and checking the box below, I acknowledge that I have received and read the separate Disclosure Regarding Background Investigation and the Summary of Your Rights Under the Fair Credit Reporting Act, and I authorize A&A Terra Inc to obtain consumer reports about me from the consumer reporting agency named above, for platform eligibility purposes, now and, to the extent permitted by law, while I remain on the platform.
- Full legal name: ______________________
- Signature (typed): ____________________
- Date: ____________
- ☐ I authorize the background check described above.
State notices (counsel to finalize): California, Minnesota, Oklahoma, New York, and Washington applicants may request a free copy of the report (check box shown by state). Ohio and Texas: no additional state-specific disclosure currently identified — counsel and the agency to confirm.
Editor's notes (not part of the disclosure — never shown on the disclosure screen)
- To keep the disclosure standalone, nothing else (fees, the adverse-action process, liability terms, demo notes) belongs on the disclosure itself. Those live in the Independent Contractor Driver Agreement §3.2–3.2B and the Driver Fee & Earnings Disclosure.
- Investigative consumer reports. The wording "character, general reputation, personal characteristics, and/or mode of living" describes investigative consumer reports (FCRA § 606), which carry extra notice duties. If the CRA package does not include interviews/investigative reports, counsel should consider removing that phrase. [Counsel + CRA to decide.]
- The CRA's name, address, phone and website must be filled in before launch (in the app screen too).
- In demo mode no real background check is ordered and no SSN or ID image is collected.
- In the app (Nov 6): screen 1 shows only this disclosure — no draft banner, no demo note, no form — in the normal page flow (not a nested scroll box), and "Next" unlocks once the driver has scrolled to its end. Screen 2 is the authorization. The consent record stores the language shown (en / ru / uz), a SHA-256 of the exact disclosure text shown, whether it was read to the end, the CRA name and the rights-summary link. The Russian and Uzbek screens say the English version is the official one. [Counsel: approve the RU/UZ translations; the CFPB publishes the summary in other languages — link the matching one if available.]
